Terms of Service

Effective date: February 1, 2026

These Terms of Service (“Terms”) govern your access to and use of the Peak Time Garage website, store, and any related content, features, tools, products, and services (collectively, the “Services”). In these Terms, “Peak Time Garage”, “we”, “us”, and “our” refers to the store operator.

By visiting, browsing, or purchasing from our Services, you agree to these Terms. If you do not agree, do not use the Services.

1) Definitions

For clarity, the following definitions apply:

Digital Products: Any downloadable product, including sample packs, presets, one-shots, loops, MIDI, project files, stems, and any other digital files.
Physical Products: Any non-digital item, including vinyl records and other curated retail goods.
Third-Party Fulfilled Products: Physical Products sourced and shipped by independent distributors/suppliers (not shipped by us).
Order: A purchase submitted through our checkout.
You / Customer: Any visitor, user, or purchaser of the Services.

2) Eligibility and Accounts

You must be capable of entering a legally binding agreement in your jurisdiction to use the Services.

If you create an account, you are responsible for maintaining accurate information and for activity that occurs under your account. Account access methods may change over time depending on platform capabilities.

3) Orders, Pricing, and Payments

3.1 Orders Are Offers

Placing an Order is an offer to purchase. We may accept, reject, cancel, or limit Orders in our discretion where permitted by law (including where we suspect fraud, abuse, pricing errors, or unauthorized activity).

3.2 Pricing and Errors

Prices may change at any time. If a product is listed at an incorrect price due to an error, we may cancel the Order and issue a refund for amounts paid for that item.

3.3 Payment Processing

Payments are processed through third-party payment providers. We do not store your full payment card details.

4) Digital Products — Delivery, Access, and License

4.1 Delivery / Made Available

Digital Products are considered delivered or made available when a download link, file access, or digital delivery is provided to you (whether or not you download it).

4.2 License Grant (What You’re Allowed To Do)

Unless otherwise stated on the product page, when you purchase a Digital Product you receive a non-exclusive, non-transferable, revocable license to use the Digital Product for your own music production and creative work.

4.3 Strict Prohibition on Sharing / Redistribution

You must not, and must not allow others to:

  • share, resell, redistribute, sublicense, rent, lease, gift, trade, or transfer Digital Products

  • upload files to file-sharing sites, forums, torrents, “drive” links, or any public/private distribution system

  • repackage our Digital Products as your own sample pack/preset pack or competing product

  • use any method to bypass access controls or download limits

  • scrape, copy, or mirror our product pages or content for commercial use

This applies even if you “only share with a friend”, “split the cost”, or “send to your engineer”. No exceptions unless we give written permission.

4.4 Enforcement

If we reasonably suspect unauthorized sharing, abuse, or fraud, we may suspend access, cancel Orders, and/or refuse future service where permitted by law.

4.5 Sample Clearance (Where Applicable)

Some Digital Products may include sounds that require additional permissions, rights, or clearances for certain uses (including commercial release). You are solely responsible for ensuring you have the necessary permissions and clearances for your intended use, where applicable. Peak Time Garage does not guarantee clearance for every possible use case. Peak Time Garage makes no representation that all sounds are cleared for all uses.


5) Third-Party Fulfilled Physical Products (Curated Retail / Vinyl)

5.1 Fulfilment and Shipping

Some Physical Products are Third-Party Fulfilled Products. We curate and list these items, but we do not manufacture them, hold stock, or ship them.

By purchasing a Third-Party Fulfilled Product, you acknowledge that:

  • inventory is controlled by the distributor/supplier

  • shipping, tracking, and delivery timelines are handled by the distributor/supplier and carriers

  • delays caused by carriers, customs, weather, or distributor operations are outside our direct control

  • customs/import duties (if any) are your responsibility

5.2 Customer Details Shared for Delivery

To fulfil Third-Party Fulfilled Products, we may share necessary delivery details (such as name, shipping address, email address, and phone number) with the distributor/supplier and their carriers.

6) Returns, Refunds, and Cancellations

Our Return & Refund Policy applies to all purchases and is incorporated into these Terms by reference.

Digital Products are non-returnable and non-refundable once delivered or made available, except only as expressly stated in our Return & Refund Policy.

If there is a conflict between these Terms and the Return & Refund Policy on refunds/returns, the Return & Refund Policy controls for those topics.

7) Promotions and Discount Codes

Discount codes and promotions may be changed, suspended, or ended at any time. Unless stated otherwise, promotions cannot be combined and do not apply to previous Orders.

8) Acceptable Use

You agree not to misuse the Services. Prohibited conduct includes:

  • fraud, chargeback abuse, or false claims

  • attempts to access systems, accounts, or data you do not have permission to access

  • interference with site performance or security

  • harassment, threats, or abusive conduct toward our staff or service providers

  • use of the Services for unlawful activity

We may restrict or terminate access where permitted by law.

9) Intellectual Property

All content on the Services (including branding, text, graphics, audio examples, product names, and Digital Products) is owned by or licensed to Peak Time Garage and is protected by intellectual property laws.

You may not use our trademarks, branding, or copyrighted materials without written permission, except as required for lawful use of purchased Digital Products under the license in Section 4.

10) Disclaimers

To the maximum extent permitted by law:

  • The Services and products are provided “as is” and “as available”.

  • We do not guarantee uninterrupted access, error-free operation, or that files will be compatible with all devices/software.

  • You are responsible for ensuring your setup can use the file formats listed on the product page.

Nothing in these Terms excludes consumer rights that cannot be excluded under applicable law.

11) Limitation of Liability

To the maximum extent permitted by law, Peak Time Garage will not be liable for indirect, incidental, special, or consequential damages arising from or related to your use of the Services or any products.

To the maximum extent permitted by law, our total liability for any claim will not exceed the amount you paid for the specific product(s) giving rise to the claim.

12) Chargebacks, Disputes, and Fraud

Chargebacks and payment disputes do not override these Terms or our Return & Refund Policy.

For Digital Products, we may provide evidence of delivery/access and verification details to dispute processors. Fraudulent disputes, false claims, or abuse may result in loss of access and refusal of future service where permitted by law.

13) Privacy

Our Privacy Policy explains how we collect, use, and disclose personal information. By using the Services, you agree to the practices described in the Privacy Policy.

14) Changes to the Services or Terms

We may update these Terms from time to time. The version in effect at the time of your purchase applies to that purchase. Continued use of the Services after changes means you accept the updated Terms.

15) Governing Law / Jurisdiction

These Terms are governed by the laws of New Zealand, to the maximum extent permitted by law. Any disputes arising from or related to these Terms or any purchase made through Peak Time Garage will be subject to the jurisdiction of the courts of New Zealand.

Nothing in these Terms is intended to exclude, restrict, or modify any consumer rights that cannot be excluded under applicable law, including rights you may have in your country of residence.

16) Severability

If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining parts will remain in full force and effect.

17) Entire Agreement

These Terms, together with our Return & Refund Policy and Privacy Policy, set out the full terms that apply to your use of the Services and purchases made through Peak Time Garage, and apply in addition to any product-specific terms stated on the product page.
